Texas man gets drunk in a bar, has a fight, sues the bar for it... and wins

That's what happens in a country that basically has more lawyers than people

A man in Texas has just won a multi-million-dollar lawsuit that he filed against a restaurant (La Fogata Mexican Grill) which, according him, "over-served" him thus causing the altercation that took place after he left the bar.

The incident took place in May 2019 and Rawls claimed to have sustained a "serious and debilitating" head injury after being assaulted by one Robert Henrickson. It's unclear whether Rawls sued Henrickson or not, but he did sue the restaurant, including the owner and the unnamed bartender for over-serving both Rawls and Henrickson, and allowing them to leave the bar together.

The lawsuit was made up of five claims, chief among which was the restaurant's "liability, negligence and damages arising from foreseeable criminal conduct." In other words, he said it was the bar's fault for failing to realize he was already a bit tipsy and things could go south.

According to the Houston Chronicle, Daniel Rawls, Andrews County resident in Texas with a history of excessive drinking (he was arrested at least twice on charges of public intoxication), was awarded $5.5 million settlement in a hearing on July 27th after the restaurant owner failed to respond to the suit or attend the hearing. La Fogata has 30 days to appeal the ruling.

  • I certainly hope the restaurant owner and bartender contest this ridiculous ruling. I wonder if the judge is related to Mr. Rawls?
